    You are granted a limited, non-exclusive, non-transferable license to access and use the App for personal diabetes management. You agree not to use the App for any illegal or unauthorized purpose.

    You are responsible for maintaining the confidentiality of your account and password. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

  5. Limitation of Liability

    To the fullest extent permitted by law, JDC Care, its affiliates, and their respective officers, directors, employees, agents, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the App.

    We reserve the right to modify these Terms of Use at any time. We will notify you of any changes by posting the new terms on the App. Your continued use of the App after changes are made constitutes your acceptance of the new terms.


  7. Governing Law

    These Terms and Conditions are governed by and construed in accordance with the laws of India. Any disputes arising from the use of this app will be subject to the exclusive jurisdiction of the courts of Trivandrum, Kerala, India.


  8. Compliance with the Information Technology Act, 2000

    This app complies with all relevant provisions of the Information Technology Act, 2000, particularly regarding the handling of sensitive personal data.


    • • Section 43A : Compensation for failure to protect data. If a corporate body that handles sensitive personal data is negligent in maintaining reasonable security practices, resulting in wrongful loss or gain to any person, that body corporate shall be liable to pay damages by way of compensation to the affected person.

    • • Section 43 : Penalty and compensation for damage to computer, computer system, etc. If any person, dishonestly or fraudulently, accesses a computer resource or causes damage, they may be liable for penalties and compensation.

    • • Section 66 : If any person, dishonestly or fraudulently, does any act referred to in Section 43, they shall be punishable with imprisonment for a term which may extend to three years, a fine of up to five lakh rupees, or both.

    • • Section 72A : Disclosing personal information without consent or in breach of a lawful contract may result in imprisonment for up to three years, a fine of up to five lakh rupees, or both.

    This app operates as an intermediary and adheres to Section 79 of the Information Technology Act, 2000, and is not liable for third-party information unless it is involved in wrongdoing.
